Terms and Conditions
I. TERMS AND CONDITIONS
These terms and conditions form an integral part of the contract for work concluded between the customer and the contractor, the subject of which is the creation of photographic works and the provision of photographic services by the contractor.
An integral part of these terms and conditions is the contractor's current price list published on their website.
These terms and conditions take effect on 27 November 2025.
The contractual relationship between the customer and the contractor is governed by the legal order of the Czech Republic, in particular Sections 2586 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter the "Civil Code").
II. CONTRACTOR
The contractor refers to Sláva Kemper, ID No. 06074791, registered at U svobodárny 2460/5, Prague 9, 190 00 (hereinafter the "Photographer").
III. CUSTOMER
The customer refers to a natural person over 18 years of age who contacts the Photographer with a request to create a work.
IV. CONTRACT FOR WORK
By the contract for work, the Photographer undertakes to create for the customer, on a pre-agreed date, photographic works capturing the customer (or, based on an express agreement between the customer and the contractor, other persons) in the quantity and theme chosen by the customer from the Photographer's current offered packages, and to deliver these photographic works in digital form to the customer. The customer undertakes to pay the contractor the price of the work stated in the selected package and to provide the contractor with the necessary cooperation.
V. BOOKINGS FOR PHOTO SESSIONS
A session date can be booked by phone, via a message on the Photographer's website, or by email at: hello@slavkakemper.com.
The Photographer will first confirm to the customer whether the given date is available. For a binding reservation of the date, the customer must send a deposit of 50% of the agreed package price (hereinafter the "Deposit") to the Photographer's bank account no later than 3 days from the date of confirmation. If the Deposit is not credited to the Photographer's bank account within this period, or the customer does not otherwise demonstrably provide proof of payment (such as a payment confirmation), the customer's booking is considered unacceptable without further action and the date is released for another customer.
By placing the booking and sending the Deposit, the customer confirms that they have familiarised themselves with these terms and conditions, the Photographer's current price list, and the Photographer's shooting style.
VI. CONCLUSION OF THE CONTRACT FOR WORK AND ITS CHANGES
The contract for work is concluded on the date the Deposit is credited to the Photographer's bank account.
The Photographer reserves the right, in exceptional situations, to change the photo session date after the contract has been concluded. The Photographer must inform the customer without delay and agree on a new date that is suitable for the customer.
The customer is not entitled to change the photo session date. If the customer is unable to attend the session for serious reasons, they must inform the Photographer without undue delay.
VII. PRICE OF THE WORK AND PAYMENT TERMS
The price depends on the selected package. The price list is available on the Photographer's website.
The payment deadline for the Deposit is set out in Article V(3) of these terms and conditions.
The remaining balance is payable in cash or by bank transfer on the day of the session, immediately after the session ends.
A payment receipt will be sent electronically to the customer's email within 3 days after the session along with the preview images.
If the customer orders additional photos beyond the agreed package, these must be paid to the Photographer's bank account within 3 days of selecting the additional photos. Any delay in payment extends the delivery time for the final edited photos.
VIII. CUSTOMER OBLIGATIONS
The customer must provide the Photographer with the cooperation necessary to carry out the work. In particular, the customer must arrive on time at the Photographer's studio (or another location communicated by the Photographer). The customer is responsible for their own transport.
A late arrival does not entitle the customer to an extension of the session.
If the customer fails to provide the necessary cooperation (especially by failing to appear on time), it is considered a material breach of their obligations
IX. DELIVERY OF THE AGREED NUMBER OF PHOTOS
The Photographer will send previews to the customer's email within 3 days after the session. All previews are low quality, constitute the Photographer's copyrighted work, and may not be distributed or published. They serve solely for selecting photos for editing.
The final edited photos—constituting the actual work—will be delivered digitally in print quality.
The Photographer typically sends the agreed number of edited photos within 1 month after the customer selects them. In cases of force majeure, illness, or a high workload, this period may be extended. Any customer request to modify the contract may also extend the delivery time.
The work is considered delivered at the moment the photos or download link are emailed. The Photographer is not required to resend links that expired because the customer did not download the photos in time.
If the customer does not select the agreed number of photos within 1 month of receiving previews, the Photographer may extend the editing deadline or withdraw from the contract. In that case, the Photographer is entitled to a contractual penalty equal to the price of the work.
X. PHOTO EDITING AND STORAGE
THE PHOTOGRAPHER DOES NOT PROVIDE UNEDITED PHOTOS!
The price includes basic retouching (skin retouch, wrinkle smoothing, slight proportion adjustments).
Advanced retouching (significant body changes, root retouch, nail edits, teeth edits, tattoo removal, etc.) can be provided for an extra fee upon agreement.
Unedited photos are stored for up to two months from the session date. Edited photos are stored for 1 month from delivery.
XI. COMPLAINTS ABOUT DEFECTS
The customer must inspect the delivered photos immediately. If the customer finds a defect, they must report it without undue delay, no later than 14 days after delivery, to hello@slavkakemper.com, stating the nature of the defect.
The Photographer will assess the complaint within 30 days and, if justified, correct the defect or provide a reasonable discount.
A defect includes, for example, delivery of fewer edited photos than agreed.
The customer acknowledges that the Photographer edits photos according to their own style and taste; dissatisfaction with the artistic style is not grounds for complaint.
Dissatisfaction with personal appearance, makeup, or clothing choices is also not grounds for complaint.
XII. WITHDRAWAL FROM THE CONTRACT
A customer who is a consumer and concluded the contract remotely may withdraw from it without stating a reason within 14 days from conclusion, by sending a WITHDRAWAL NOTICE to hello@slavkakemper.com.
If the contract is concluded less than 14 days before the session date, the customer expressly agrees to begin performance before the 14-day period ends and loses the right to withdraw.
The Photographer may withdraw if the customer materially breaches their obligations. In such a case, the Photographer is entitled to a contractual penalty equal to the price of the work.
XIII. OWNERSHIP AND COPYRIGHT
All photos and previews are copyrighted works belonging to the Photographer. They may not be used commercially, for advertising, or sold to third parties without written consent.
Ownership and copyright of all unedited photos and previews belong solely to the Photographer. The customer may not use, publish, or modify them. Violation results in a penalty of CZK 100,000 per breach.
Copyright to edited photos also remains with the Photographer. The customer may only use them for their personal, non-commercial purposes. Editing or presenting them as their own work is prohibited. Violations incur a CZK 100,000 penalty. A licence agreement may be arranged for other uses.
XIV. CONSENT TO USE OF PHOTOS FOR THE PHOTOGRAPHER'S PRESENTATION
By concluding the contract, the customer consents under Section 84 of the Civil Code to having their likeness captured in any manner.
By concluding the contract, the customer further consents under Section 85 to the Photographer publishing their photos in their portfolio, on social media, or on their website.
If the customer does not wish their likeness to be published, they must inform the Photographer (no later than after the session).
XV. PERSONAL DATA PROTECTION
The Photographer is the data controller under Article 4(7) GDPR.
Certain personal data must be processed to provide photographic services.
Personal data means any information relating to an identified or identifiable person.
The controller processes personal data provided by the customer or obtained during performance of the contract, specifically:
• name and surname
• email address
• phone number
• address
The legal grounds for processing are contract performance (Art. 6(1)(b)) and legal obligations (Art. 6(1)(c)).
The purpose is to process the order and fulfil the contract. Without these personal data, the contract cannot be concluded or performed. The purpose also includes fulfilling legal obligations to state authorities.
The Photographer stores personal data for the period necessary to fulfil contractual rights and obligations (15 years from contract termination). After this period, data are deleted.
Recipients include persons involved in providing services and performing the contract. The Photographer does not intend to transfer data outside the EU.
Processing is carried out by the Photographer. Under GDPR, the customer has the rights: access (Art. 15), rectification (Art. 16), restriction (Art. 18), erasure (Art. 17), objection (Art. 21), and data portability (Art. 20). The customer may also lodge a complaint with the Data Protection Authority or a court.
The Photographer declares that appropriate technical and organisational measures have been implemented. Only authorised persons have access to data.
By submitting the order and paying the Deposit, the customer acknowledges and accepts the personal data terms.
